1.  GENERAL PROVISIONS

1.1. The Internet shop available at the Internet address www.goodlooki-shop.com is ran by ANDRZEJ CHMIEL that conducts a business activity ANDRZEJ CHMIEL ENDRJU (the place of business activity and correspondence addresses: ul. Kępa Tarchomińska 6F/2, 03-113 Warszawa, Poland), registered in the Central Evidence of Information on Business Activity for the Republic of Poland conducted by the minister in charge of economic issues, Tax Identification Number 5222609017, National Business Register Number 140487479, e-mail address: service@goodlookin-shop.com.   

1.2. The Regulations are both for consumers and entrepreneurs using the Internet Shop (except for paragraph 9 of the Regulations which is directed solely for entrepreneurs). The Provisions of the Regulations are not aimed to exclude or limit any consumer rights granted due to absolutely mandatory provisions of law – any possible doubts are to be interpreted in favour of consumer. In case of incompatibility of the Regulations with the aforementioned provisions, the provisions shall apply.

1.3. Definitions:

1.3.1. WORKING DAY – one day from Monday to Friday, excluding public holidays.

1.3.2. REGISTRATION FORM – form available at the Internet Shop, enabling creating an Account.

1.3.3. ORDER FORM – Electronic Service, interactive form available at the Internet Shop, enabling placing an Order, in particular by adding Products to the electronic basket and defining conditions of Purchase Agreement, including the delivery and payment methods.

1.3.4. CUSTOMER – Service User that is going to conclude or has already concluded Purchase Agreement with the Seller.

1.3.5. CIVIL CODE - the civil code act from 23 April 1964 (Journal of Laws No 16 item 93, as amended).

1.3.6. ACCOUNT –Electronic Service, marked with a separate name (login) and a password provided by Service User, set of resources in Service Provider’s IT system, where Service User’s data, including one concerning the placed Orders, is stored.

1.3.7. NEWSLETTER – Electronic Service, electronic distribution service provided by the Service Provider via e-mail, enabling all the Service Users that use it to receive automatically contents of consecutive newsletter editions with information about Products at the Internet Shop.

1.3.8. PRODUCT – available at the Internet Shop a movable property that is a subject of Purchase Agreement between Customer and Seller.  

1.3.9. REGULATIONS – the regulations of the Internet Shop.

1.3.10 SELLER; SERVICE PROVIDER – ANDRZEJ CHMIEL conducting a business activity (the place of business activity and correspondence addresses: ul. Kępa Tarchomińska 6F/2, 03-113 Warszawa, Poland), registered (on 10th March 2006 in the evidence conducted by the President of the Metropolitan City of Warsaw No 424003) in the Central Evidence of Information on Business Activity for the Republic of Poland conducted by a minister proper for economic issues, Tax Identification Number 5222609017, National Business Register Number 140487479, e-mail address: service@goodlookin-shop.com    

1.3.11 PURCHASE AGREEMENT – Product purchase agreement being concluded or already concluded between Customer and the Seller through the Internet Shop.

1.3.12 ELECTRONIC SERVICE -  service provided electronically by Service Provider in favour of Service User through the Internet Shop.

1.3.13 SERVICE USER – a natural person with legal capacity, and in cases set forth in the generally applicable provisions of law, also a natural person with limited legal capacity, legal person or organizational unit without legal personality that is granted legal capacity by an act, that uses Electronic Service. 

1.3.14 ORDER – Customer’s declaration of will, handed in with the use of the Order Form and resulting directly in the conclusion of Product Purchase Agreement with the Seller.   

2. ELECTRONIC SERVICES AT THE INTERNET SHOP

2.1. The following Electronic Services are available at the Internet Shop: Account, Order Form, Newsletter and blog.

2.1.1. Account – using Account is possible after fulfilling the Registration Form and clicking the “Register” button. Service User is required to complete the Registration Form with the following Service User’s data: account name, name and surname, address for Products delivery (street, house/flat number, town with postcode, country), e-mail address, contact telephone number and password. In the case of Service Users that are not consumers, it is necessary to provide company name and Tax Identification Number (NIP).    

2.1.2. Order Form – using the Order Form begins with the moment of adding a first Product to the electronic basket at the Internet Shop. Placing an Order takes place after fulfilling the Order Form and clicking the “Order with compulsory payment” button – till this moment there is a possibility to modify the data provided (in order to do that, one has to follow the displayed messages and information available on the Internet Shop website). Customer is required to provide in the Order Form the following data: name and surname/company name, address (street, house/flat number, town with postcode, country), e-mail address, contact telephone number, Products, number of Products, place and way of delivering the Products, way of payment. In case of Customers that are not consumers, it is necessary to provide company name and Tax Identification Number (NIP).         

2.1.3. Newsletter – using the Newsletter takes place after typing an e-mail address into the “Newsletter” bookmark, visible on the website of the Internet Shop, where subsequent Newsletter editions will be sent to, and after clicking the “Order Newsletter” button. One may subscript to the Newsletter by ticking the right checkbox during creating an Account or placing an Order. At any moment can a goodlookin-shop.com Newsletter receiver resign from receiving it by clicking the link attached to the Newsletter at the bottom of a message. 

2.1.4. Blog – using the blog takes place after clicking the „Blog” bookmark on the website of the Internet Shop.

2.2. Using Electronic Services by Service User is free of charge.

2.2.1. Account, Newsletter and blog at the Internet Shop are provided for an indefinite period of time.

2.2.2. Using the Order Form is for single use only and ends with the moment of placing an Order with the Form use.

2.3. Technical requirements indispensible for cooperation with the IT system used by the Service Provider: 

2.3.1. A computer, laptop or other multimedia device with access to the Internet.

2.3.2. Access to e-mail.

2.3.3. Internet browser: Mozilla Firefox, version 11.0 and newer or Internet Explorer, version 7.0 and newer, Opera, version 7.0 and newer, Google Chrome, version 12.0.0 and newer.

2.3.4. Recommended minimal screen resolution: 1024×768. 2.4. Service User is obliged to use the Internet Shop in accordance with the law and good  standards, to have on mind respect for third parties’ personal interests and intellectual property.  

2.5. Service User is obliged to enter data corresponding with the actual situation.

2.6. Providing illegal contents by Service User is forbidden.   

3. CONDITIONS OF CONCLUDING PURCHASE AGREEMENT

3.1. Announcements, advertisements, pricelists and other information about Products provided on the Internet Shop’s websites, in particular their descriptions, technical and utility parameters and prices, are an invitation to conclude an agreement, as understood by Art. 71 of the Civil Code.

3.2. Product price visible on the website of the Internet Shop is given in PLN and includes all the components, like VAT and duties. However, the prices do not include possible delivery costs and payments which are displayed during placing an Order.  

3.3. Product’s price displayed on the Internet Shop’s website is binding from the moment of placing an Order by Customer. The Price does not change notwithstanding price changes at the Internet Shop, which may happen in relation to some of Products after placing an Order by Customer.

3.4. Concluding Purchase Agreement at the Internet Shop with the Order Form

3.4.1. Concluding Purchase Agreement occurs prior to placing an Order by a Customer.  

3.4.2. After placing an Order, the Seller shall immediately confirm its receiving, which binds the Customer with the Order, and shall accept the Order to realization. Confirmation of receiving an Order and its acceptance for realization occurs through sending an appropriate e-mail message to Customer’s e-mail address provided during placing Order, including at least confirmation of all necessary Order’s elements, Seller’s declarations on receiving Order and its acceptance for realization.

3.4.3. With the moment of receiving an e-mail message by Customer, mentioned in clause

3.4.4., Purchase Agreement between Customer and Seller shall be concluded.

3.4.5. of the Regulations. The Purchase Agreement content is additionally consolidated and protected in the IT system of the Seller’s Internet Shop.

3.5. Consolidation, protection and release of the Purchase Agreement content to Customer occurs through (1) release of the Regulations on the website of the Internet Shop and (2) sending an e-mail message to Customer, mentioned in clause

3.6. Having sent the purchased goods, within the field of the agreement realization with Buyer, the Seller is obliged to send to Buyer’s e-mail address an invitation to complete a questionnaire for the opinion research on the conducted transaction. Buyer is entitled, but not obliged, to complete the questionnaire.

4. PAYMENT METHODS

4.1. Seller provides the following payment methods:

4.1.1. Cash on delivery.

4.1.2. Bank account with personal receipt.

4.1.3. Money transfer to Seller’s bank account.

4.1.3.1. Bank: mBank

4.1.4. Electronic payments and payments with payment cards through the website PayU.pl – possible current ways of payment are laid down on the website of the Internet Shop before performing payment and on the website http://www.payu.pl/.

4.2. Settling transactions with electronic payment and a payment card is conducted due to Customer’s choice via the website PayU.pl.

4.3. Electronic payments and payments with a payment card are handled by:

4.3.1. PayU.pl – company PayU S.A. with the headquarters in Poznań (headquarters’ address: ul. Grunwaldzka 182, 60-166 Poznań, Poland), entered into the Register of Entrepreneurs of the National Court Register No 0000274399, records kept by District Court in Poznań – Nowe Miasto and Wilda in Poznań, share capital PLN 4,000,000 completely paid-up, Tax Identification Number: 779-23-08-495.

5. COSTS, WAYS AND DEADLINES OF PRODUCTS DELIVERY

5.1. Seller provides Customer with the following ways of delivery or receipt of Product:

5.1.1. National delivery - by DPD Polska courier company, delivery time 1-3 Working Days;

5.1.2. Cross-border delivery - by DPD Polska courier company, delivery time 5-7  Working Days; ordinary courier service (relates to: Austria, Belgium, Bulgaria, Croatia, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Great Britain and Northern Ireland, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden);   - by Poczta Polska (Polish Post), delivery time from 7 to 14 Working Days; letter services and postal parcels.

5.1.3. Personal receipt from: Mehoffera St. 60A apartment 1, 03-131 Warszawa, Poland – on Working Days from 11 a.m. to 4:30 p.m. by prior arrangement.

5.2. Product delivery is available in the territory of the Republic of Poland and in other parts of the world (other delivery pricelists).

5.3. Possible delivery costs are indicated while placing an Order. They are dependent on delivery and payment methods selected by Customer. Delivery costs are also indicated on the Internet Shop’s website in the “Delivery costs” bookmark.

5.4. The deadline for orders realization and product delivery to Customer is from 1 to 5 Working Days (for national delivery), unless a Product description indicates a shorter period or it has been stated during placing an Order. The deadline is to be sorted out in the following manner:

5.4.1. Providing Customer chooses the payment by bank transfer or electronic payment – from the day of acceptance of Seller’s bank account or settlement account.

5.4.2. Providing Customer chooses the payment on delivery – from the day of concluding Purchase Agreement.

5.5. We send our goods to every country in the world.

5.5.1. Delivery costs to the aforementioned countries are indicated on the Internet Shop’s website in the „Delivery costs” tab.

6. CONDITIONS OF TERMINATION OF AGREEMENTS FOR PROVIDING ELECTRONIC SERVICES

6.1. Service Provider and Service User may terminate agreement for providing Electronic Services at any time by mutual agreement.

6.2. Termination of agreement for providing Electronic Services:

6.2.1. Agreement for providing Electronic Services, that has unlimited duration and is continuous, can be terminated (e.g. Account).

6.2.2. Service User may terminate an agreement for providing Electronic Services without indicating any reasons by sending an appropriate declaration via e-mail to the address: service@goodlookin-shop.com, or in written to the address: ul. Kępa Tarchomińska 6F/2, 03-113 Warszawa, Poland. In this case, the agreement is terminated after 7 days from submitting the declaration of will on termination (notice period), unless the parties agree on a shorter notice period.

6.2.3. In the case of Service Users that are consumers, Service Provider may terminate the agreement for providing Electronic Services if the Service User objectively and blatantly, or persistently, infringes the Regulations, in particular, if provides illegal contents, after an ineffective, at least one, call to stop or remove the infringements, with determining a proper deadline for this. Infringement of the Regulations needs to be objective and illegal. In this case, the agreement for providing Electronic Services is terminated after 14 days from issuing by the Service Provider the declaration of will on its termination to Service User (notice period).

6.2.4. In the case of Service Users that are not consumers, Service Provider may terminate an agreement for providing Electronic Services with immediate effect and without indicating reasons by sending a proper declaration to Service User.

7. COMPLAINT PROCESSING

7.1. Seller is obliged to provide Customer with Product free of any defects.

7.2. Complaints resulting from the warranty for physical defects:

7.2.1. The basis and scope of Seller’s responsibility to Customer that is a natural person obtaining a Product for reasons not related to professional or economic activities, resulting from Product physical defect, are specified in particular by the civil code act from 23 April 1964 (Journal of Laws No 16 item 93, as amended), and other generally applicable provisions of law.

7.2.2. Statements concerning Product’s physical defect and notifications of proper requests may be issued via e-mail to the address: service@goodlookin-shop.com or in written to the address: ENDRJU Andrzej Chmiel, ul. Mehoffera 60A, 03-131 Warszawa, Poland. If it is possible and indispensible for the Product physical defect assessment, it should be also delivered to the aforementioned address. 

7.2.3. Seller shall immediately reply to Customer’s request, and no later than within 14 days.

7.2.4. Providing Products also subjected to guarantees, the Seller informs that guarantee covering the sold consumption goods does not exclude, limit nor suspense buyer’s entitlements resulting from the goods incompliance with the agreement.

7.3. Complaints related to providing Electronic Services by Service Provider, and other complaints related to the Internet Sop’s performance:

7.3.1. Service User may submit complaints related to providing Electronic Services via the Internet Shop, and other complaints related to performance of the Internet Shop via e-mail to the address: service@goodlookin-shop.com or in written to the address: ENDRJU Andrzej Chmiel, ul. Mehoffera 60A, 03-131 Warszawa, Poland.

7.3.2. It is advised to include in the complaint description as much information and circumstances concerning object’s complaint as possible, in particular a kind and date of defect occurrence, as well as contact data – this is to enhance and accelerate settling a complaint by the Service Provider. 

7.3.3. Service Provider shall immediately reply to a request, and no later than within 14 days.

7.3.4. Service Provider’s reply regarding complaint is sent to the address submitted by Service User, unless the Service User provides another method. 

7.4. Buyer that is a consumer has a possibility to use an extrajudicial way of settling complaints and redress at the Permanent Consumer Arbitration Court by Provincial Inspectorate of the Trade Inspection in [city]. 8. RIGHT TO WITHDRAWAL FROM AGREEMENT

8.1. Service User/Customer that is a consumer and concluded a distance agreement may withdraw from the agreement without giving a reason within thirty days by handing in a proper declaration. To meet the deadline it is enough to send a declaration prior to its expiration. A declaration of the withdrawal from agreement may be handed in: ENDRJU Andrzej Chmiel, ul. Mehoffera 60A, 03-131 Warszawa, Poland.  

8.2. Providing withdrawing from agreement, the agreement shall be considered non concluded, and consumer shall be released from any liabilities. What the parties have declared shall be returned in unchanged state, unless the change was indispensible within ordinary management. The return shall take place immediately, not later than in fourteen days. If consumer has made any prepayments, he shall receive statutory interests from the day of making the prepayment.

8.3. Seller shall return payment in the same way as used by consumer, unless the Consumer has clearly agreed to a different way of return that does not bear him any burdens.

8.4. The thirty-day deadline when consumer can withdraw from agreement is to be sorted out for Purchase Agreement from the day of receiving a Product by Customer, an if the agreement is related to providing Electronic Services, from the day of its conclusion.

8.5. Consumer shall bear direct costs of products  return. 

8.6. The right to withdrawal from a distance agreement does not apply to a consumer when: (1) providing a service began prior to consumer’s agreement before deadline expiration mentioned above in clauses 8.1 and 8.4; (2) this concerns audio and audio-visual recordings, as well as data recorded on IT data media after removing their original packaging by consumer; (3) agreements regarding services when the price or wage is dependent solely on financial market fluctuations; (4) services of the character specified by consumer in the placed order or directly related to him; (5) services that due to their character may be returned or their object is subjected to quick damage; (6) press delivery; (7) gambling services.

9. PROVISIONS REGARDING ENTREPRENEURS

9.1. This clause of the Regulations with its provisions are related solely to Customers that are not consumers.

9.2. In the case of Customers that are not consumers, the Seller has the right to limit the available ways of payment, but also to require to make a full or partial prepayment, notwithstanding the way of payment chosen by Customer in the Order Form or the fact of concluding Purchase Agreement. 

9.3. In the case of a payment method different from cash on delivery, Customer that is not a consumer is obliged to make the payment resulting from Purchase Agreement within 7 days from the day of its conclusion, unless the Purchase Agreement states different.

9.4. With the moment when the Seller hands out a Product to a carrier, Customer that is not a consumer acquires benefits and burdens related to the Product and a danger of accidental loss or damage of the Product. In such a case, the Seller shall not be liable for the loss, shrinkage or damage of the Product, created from taking it over for carrying it to delivery to Customer, as well as for delay in delivery.

9.5. According to Art. 545 § 2 of the Civil Code, in the case of sending a Product to Customer with the use of a carrier, Customer that is not a consumer is obliged to examine the parcel in the moment and in the way admitted for such parcels. If he states that during the transport Product shrinkage or damage took place, he is obliged to perform any actions to settle responsibility of the carrier. 

10. PERSONAL DATA

10.1. The administrator of Service Users’/Customers’ personal data collected by the Internet Shop is: ANDRZEJ CHMIEL that conducts a business activity ANDRZEJ CHMIEL ENDRJU (the place of business activity and correspondence addresses: ul. Kępa Tarchomińska 6F/2, 03-113 Warszawa, Poland), registered in the Central Evidence of Information on Business Activity for the Republic of Poland conducted by a minister proper for economic issues, Tax Identification Number 5222609017, National Business Register Number 140487479, e-mail address: service@goodlookin-shop.com  

10.2. Service Users’/Customers’ personal data collected by the administrator by the Internet Shop are collected – according to User’s/Customer’s will – in order to realize Purchase Agreement or an agreement for providing Electronic Services.

10.3. Service User/Customer has got the right to access their data and correct them.

10.4. Providing personal data is voluntary, nevertheless, not providing the data indicated in the Regulations, necessary for concluding Purchase Agreement or an agreement for providing Electronic Services, results in the refusal of concluding the agreement. Data indispensible for concluding Purchase Agreement or an agreement for providing Electronic Services is indicated on the Internet Shop’s website every time before concluding an agreement.

10.5. In order to realize an agreement, the internet shop can share your data with the following entities: DPD Polska Sp. z o.o. ul. Mineralna 15  02-274 Warszawa Poland   Poczta Polska S.A. ul. Malborska 130 30-624 Kraków Poland   In such cases, the amount of shared data is limited to the required minimum. Moreover, your data can be shared with proper official authorities if it is required by applicable provisions of law.

11. FINAL PROVISIONS

11.1. Agreements concluded through the Internet Shop are concluded in accordance with the Polish Law, and in Polish language.

11.2. Regulations change:

11.2.1. Service Provider shall reserve the right to perform changes in the Regulations due to important reasons, which are: changes in the law; changes in the way of payment and delivery; changes in the field of payment or form of provided Electronic Services, change of Seller’s address – in the scope that the changes do not affect implementations of the provisions of the Regulations.

11.2.2. The changed regulations shall bound Service User if requirements specified in Art. 384 of the Civil Code were preserved, which means that Service User was correctly notified of changes, and he did not withdraw from the agreement for providing continuous Electronic Services within 14 calendar days from the day of notification.

11.2.3. The Regulations changes shall not in any way violate the rights acquired by Service Users that are consumers and use the Internet Shop, acquired before the date of the changes implementation, especially, the Regulations changes shall not affect Orders being placed or placed, as well as concluded, executed or implemented Purchase Agreements. 

11.2.4. Providing the Regulations change resulted in implementation of any new payments or increasing the existing ones, Service User that is a consumer has the right to withdraw from the agreement.

11.3. In issues not defined by the Regulations, the respective provisions of the Polish law shall apply: the Civil Code; the act of providing services electronically of 18 July 2002 (Journal of Laws 2002 No 144, item 1204, as amended); the consumer rights act of 30 May 2014 (Journal of Laws 2014, item 827, as amended); the civil code Act of 23 April 1964 (Journal of Laws No 16, item 93, as amended) and other relevant provisions of generally applicable law.

11.4. Any disputes aroused between the Service Provider/Seller and a Service User/Customer that is a consumer are subjected to proper common courts. Disputes aroused between the Service Provider/Seller and a Service User/Customer that is not a consumer are subjected to a court proper for the Service Provider’s/Seller’s headquarters. I. PayU account is a service free of charge for buyers on the Internet. It allows fast and safe online transactions without registering at a shop. PayU is:

•       a single-use registration enabling constant access to a lot of online shops

•       quick transactions

•       well organized history of your purchases

•       tracking what you have bought online

•       insight in all the operations

•       full control of your budget

•       promotions and discounts at selected shops

II. Paybynet service is an attractive tool for online payments in a popular scheme in Poland of automatic filling in a transfer. Paybynet online payments are quick, reliable and exceptionally safe.  Paybynet is:

•      safety – transfer is made directly from buyer’s account to seller’s or office’s account without retaining the money by an intermediate body. You see on the transfer who you are transferring the money to;

•      speed – information concerning payment is transmitted immediately to the shop, which accelerates order realization. Settling a payment is guaranteed by KIR (the National Clearing House);

•      convenience – transfer data in online banking system is completed automatically, which prevents you from making mistakes while introducing data.
